Valera has been identified as a Gujarat-based Congress worker and the alleged mastermind of the case.

On Tuesday, Nashik Police Commissioner Deepak Pandey transferred the investigation to the economic crimes wing in the case, prompting Rajasthan’s BJP to target Ashok Gehlot and the ruling Congress, which is also an ally of the MVA government of Maharashtra.

Talk to The Indian ExpressPandey said: “In his statement to the police recorded on Monday, he said he had no complaints against Vaibhav Gehlot. The plaintiff said that the main defendant in the case often took his name due to which he named him in his complaint.”

On March 17, following instructions from a Nashik court, the police filed a case under Sections 420 (cheating), 406 (criminal breach of trust), 468 (false for cheating), 471 (falsified records), 504 (intentional acts) insult), 506 (criminal intimidation) and 34 (common intention) against the 14 people, including Vaibhav Gehlot.

Police say the defendant colluded and enticed Patil, who is also a civil engineer, to invest in their business with the promise of high returns, offered him the role of a non-working partner – and duped Rs 6.8 crore.

“Initially, the case was registered based on the plaintiff’s request and the court order. The complainant’s statement was also recorded at that time. However, on Monday afternoon, he came alone to the police station and said he wanted to disclose some facts of the case. He said he named Gehlot in his complaint by mistake and wanted his name removed from the FIR, after which his additional statement was taped,” a senior officer told The Indian Express.

In the supplementary statement, Patil told police that he had never met Vaibhav Gehlot and had not given or sent him any money directly.

“Patil said he was deceived by Valera who allegedly claimed he was closely related to the Chief Minister of Rajasthan and his son. Valera also claimed that Vaibhav was part of his company, named Abhik Advertisement Pvt Ltd, and helped to enter into contracts with the government of Rajasthan,” the officer said.

The complainant told police that after verification he was now “reasonably confident” that Vaibhav was not part of the group that tricked him.

Although Vaibhav’s name has not yet been removed from the FIR, police sources said it would be done after Patil recorded his statement with the local magistrate. “We will now present him in court and his statement will be recorded again, after which the process of removing Vaibhav Gehlot’s name from the FIR will begin,” the officer said.

When The Indian Express attempted to reach Patil for comment, the call was answered by a man who described himself as a “friend of the family”. “Patil is currently admitted to the intensive care unit of a hospital and will not be able to speak,” he said.

Besides Gehlot and Valera, the other defendants in the case have been identified as Kishan Kantelia, Sardar Singh Chauhan, Pravin Singh Chauhan, Suhas Surendrabhai Makwal, Niravbhai Maheshbhai Virmabhat, Biswaranjan Mohanty, Rajbir Singh Shekhawat, Pragyeshkumar Vinodchandra Prakash, Sanjay Kumar Desai , Sawan Kumar Parner, Rishita Shah and Viraj Panchal.
